The recent Minnesota case of In re Emergency Guardianship of Albert Barnes illustrates an emerging class of cases where a dispute between a family proxy and a hospital over “medical futility” requires legal resolution. The case was further complicated by the patient’s spouse who fraudulently claimed to be the patient’s designated health care proxy and who misrepresented the patient’s previously expressed treatment preferences. Barnes demonstrates the degree of significant administrative and institutional support to the health care team, ethics consultants, and (...) futility committees that is required when a futility dispute escalates to the need for judicial resolution. An institutional futility policy, especially one that is endorsed by other regional medical centers and organizations, is an important foundation for a hospital that seeks judicial support in a dispute over medical futility in end of life care. Futility disputes are increasing and courts are slowly abandoning their historical reluctance to engage these contentious issues, particularly when confronted with inappropriate surrogate demands for aggressive treatment. Use of the judicial system to resolve futility disputes inevitably brings media attention and requires clinicians, hospitals, and families to debate these deep moral conflicts in the public eye. A recent case in Minnesota, In re Emergency Guardianship of Albert Barnes, explores this emerging trend and the complex responsibilities of clinicians and hospital administrators (...) seeking to replace an unfaithful surrogate demanding aggressive therapy. Use of the courts requires the coordinated commitment of significant institutional resources, management of intense media scrutiny and individual and organizational courage to enter the unpredictable world of litigation. Given the dearth of legislative guidance on medical futility, individual clinicians and institutions will continue to bear the difficult responsibility for resolution of individual futility disputes. The Barnes case illustrates how one institution successfully used the judicial system to replace an unfaithful surrogate, cease the provision of inappropriate aggressive care, and stimulate a community dialogue about appropriate care at the end of life. Prima facie, relative identity looks like a perfect fit for the doctrine of the Trinity since it allows us to say that the Father, Son and Holy Spirit, each of which is a Trinitarian Person, are the same God but not the same Person. Nevertheless, relative identity solutions to logic puzzles concerning the doctrine of the Trinity have not, in recent years, been much pursued. Critics worry that relative identity accounts are unintuitive, uninformative or unintelligible. I suggest that the relative (...) identity account is worth a second look and argue that it provides a coherent account of the doctrine of the Trinity. (shrink)

Medical screening is justified on the strength of the assumption that the earlier disease is detected, the better it is for the patient. On examination, however, the assumption turns out to be severely flawed, and inadequate anyway, since it is not only the patient with whom we should be concerned, but healthy people as well. Instead of making assumptions about the ill, we should prove a test's overall benefit to the individual taking it before we recommend it.

Originally published in 1918, this book contains edited English translations of French texts written by the Jansenist inhabitants of Port-Royal during the seventeenth century. Barnard provides an introduction with historical background to the state of education in France at the time, and annotates each translation with pertinent historical and literary references. This book will be of value to anyone with an interest in the history of education and the history of faith schools.

This paper attempts some integration of two perspectives on questions about rationality and irrationality: the classical conception of irrationality as sophism and themes from the romantic revolt against Enlightenment reason. However, since talk of "reason" and "the irrational" often invites rigid dualities of reason and its opposites (such as feeling, intuition, faith, or tradition), the paper turns to "intelligence" in place of "reason," thinking of human intelligence as something less abstract, less purely theoretical, and more firmly rooted in practice, (...) including communicative practice. In a symposium with Roger Trigg, Renford Bambrough remarks that in discussing the difference between reason and faith philosophers too often raise the issue in a misleading form.1 The form is that of the ‘treacherous singular’. In other words, they assume that there is a single difference between reason and faith, that a line may be drawn with faith entirely on one side and reason entirely on the other. Against this, Bambrough argues that there is no sharp (...) difference between the two, that they are related in many ways and that within the network of our discourse they come to different things at different points. Philosophers too often look only at one or two points, assume a radical divergence and produce a caricature alike of reason and of faith. A more extensive view will reveal no such radical incompatibility; rather it will enable us to see faith as a mode of reason. (shrink)

In 1958 I set down some thoughts that arose from an attempt to consider epistemological problems on the assumptions that The biology of the human nervous system is relevant to epistemology and The human nervous system, like every other object of biological investigation, is a product of evolution by natural selection. These thoughts lay more or less neglected until they were brought stunningly to mind by Professor George Gaylord Simpson's [1] recent paper on “Biology and the Nature of Science”. In (...) that paper Professor Simpson writes: “Still another consideration seems to me the most interesting of all, and yet I have never seen it clearly expressed elsewhere. It is, in a sense a validation of the ‘animal faith’ given by Russell … as sole basis for assuming that we really can obtain knowledge of the outer world. The fact is that man originated by a slow process of evolution guided by natural selection. At every stage in this long progression our ancestors necessarily had adaptive reactions to the world around them. As behavior and sense organs became more complex, perception of sensations from those organs obviously maintained a realistic relationship to the environment. To put it crudely but graphically, the monkey who did not have a realistic perception of the tree branch he jumped for was soon a dead monkey-and therefore did not become one of our ancestors. Our perceptions do give true, even though not complete, representations of the outer world because that was and is a biological necessity.”. (shrink)

Are restrictive measures and duties to care ethically reasonably acceptable to faith-based organizations? This study describes the perceptions of individually interviewed spiritual leaders of the disease control measures used during the recent SARS outbreak in Toronto. Four central themes were identified: the relationship between religious obligation and civic responsibilities; the role of faith-based organizations in supporting public health restrictive measures; the reciprocal obligations of public health and religious communities during restrictions; and justifiable limits to duties to care. We (...) conclude that, within certain constraints, spiritual leaders find restrictive measures ethically reasonable and that spiritual leaders can play an important role during pandemic and epidemic control planning. Public health officials should therefore include them in the early and ongoing deliberations of the criteria and logistics for implementation during public health emergencies. (shrink)

Comment expliquer cette disparité ? La croyance à la création revêt deux formes, l’une faible, celle du théisme, l’autre forte, celle de la foi scripturaire liée à l’Alliance, et il semble que la seconde cherche à assumer la première comme une voie sapientielle de (...) portée universelle ; mais la foi de nombreux chrétiens ne paraît même pas impliquer cette croyance faible. Cet oubli appauvrit sans doute leur foi, mais peut s’expliquer : la sécularisation a produit un effacement de la notion de création, qui a perdu son évidence culturelle, la question de l’origine est laissée à la science, le croyant trouve Dieu dans la proximité du présent et ne le cherche plus dans l’espace originaire, et des attitudes croyantes, autrefois liées à cette notion, s’expriment aujourd’hui autrement sans altération de la foi. La théologie aurait avantage à analyser le lien de la création à la culture, et à expliciter le rôle qu’y joue l’Esprit Saint dans une perspective mystique d’anéantissement ou de « décréation ».Despite an undeniable renewal of creation theology, a good number of contemporaneous Christians do not seem to have the same interest in affirming the world’s creation or a God creator. How can this disparity be explained ? Belief in creation takes on two forms : a weak one of theism and a strong one of scriptural faith tied to the Covenant. It seems that the second tries to assume the first as a sapiential way with universal import. The faith of numerous Christians, however, does not seem to even imply this weak belief. Without doubt, this omission impoverishes their faith but can be explained : secularization wiped out the idea of creation when it lost its cultural importance. The question of origins is left to science, ; the believer finds God in the proximity of the present and no longer looks for the original space. It is also true that believing attitudes, which were tied to this notion in the past, express themselves today in another way, without changing the faith. Theology would be better off if it analysed the connection of creation to culture and make explicit the role that the Holy Spirit plays in the mystical perspective of annihilation or of “de-creation”. Questions about the use of “inclusive language” in Christian discourse are trivial but the discussion which surrounds them raises an exceedingly important question, namely that of whether gender is theologically salient-whether Christian doctrine either reveals theologically significant differences between men and women or prescribes different roles for them. Arguably both conservative support for sex roles and allegedly progressive doctrines about the theological significance of gender, race, ethnicity and sexual orientation are contrary to the radical teaching of the Gospel that in (...)
